Establishing Paternity


Establishing paternity means recognizing the relationship by blood between a child and his putative father. Once established, this will greatly benefit the child by giving him a sense of identity through the knowledge of his biological parents. This will also allow a father to seek custody and visitation of their child through court action. Essentially, the child will receive financial, emotional, and health support from his father.

Paternity in Maryland can be established with or without going to court. It can be established either through:

  • Marital presumption where the law presumes that the husband is the father when the mother is married to him (father) at the time of the child’s birth
  • Signing of an Affidavit of Parentage by both parents, if the child was born to an unmarried mother
  • Judicial declaration where a court order is required and paternity can be established through genetic testing or the putative father states under oath that he is the child’s father, without any objection from the mother. For this last remedy, you may seek the help of a legal counsel.
